1. Overview and Acceptance

These Terms & Conditions (“Terms”) govern your use of the NICHE SELECT website, your purchase of products from us, and related services provided by NICHE SELECT. By accessing our website, placing an order, or using our services, you agree to these Terms.

NICHE SELECT is an independent fragrance discovery and decanting business offering curated niche perfume discovery sets and smaller fragrance formats for discovery and gifting.

2. Relationship to Our Policies and FAQ

These Terms should be read together with the policies posted on our website, including our Shipping & Delivery, Returns & Refunds, Damaged or Leaking Orders, Incorrect or Missing Items, Order Changes & Cancellations, Lost Packages, Packages Marked Delivered, Authenticity Guarantee, Decant Volume & Fill Levels, Fragrance Performance, Product Safety, Promotions & Discount Codes, Order Verification & Fraud Prevention, and Accessibility policies.

Our Frequently Asked Questions (“FAQ”) provides a plain-language summary of common customer questions. The FAQ is provided for convenience and does not override these Terms or our posted policies. If an FAQ answer is inconsistent with these Terms or a specific posted policy, these Terms and the applicable policy will control.

3. Authenticity, Independent Reflaconing, and Brand Disclaimer

NICHE SELECT sells 100% authentic fragrance. Our fragrances are sourced from reputable fragrance retailers, authorized retailers, distributors, and original boutiques, and we maintain purchasing records for our fragrance inventory.

Fragrances are independently transferred from authentic original bottles into NICHE SELECT atomizers. Our products are not sold in original manufacturer packaging unless explicitly stated otherwise.

Unless explicitly stated otherwise, NICHE SELECT is not affiliated with, endorsed by, sponsored by, licensed by, or authorized by the fragrance houses or brands featured on our website. Brand names, fragrance names, and trademarks belong to their respective owners and are used solely to identify the original fragrances being offered.

4. Products and Product Information

We may offer curated discovery sets, independently reflaconed fragrance samples, gift-ready selections, add-on samples, gift cards, and other fragrance-related products or services as shown on our website.

Available fragrances, sizes, box contents, customization options, add-ons, prices, and stock are subject to availability and are as displayed on the applicable product page at the time of purchase.

We make reasonable efforts to describe products accurately. Fragrance descriptions, notes, seasonality, occasion, longevity, projection, and similar information are provided as general guidance and are not guarantees of individual results.

5. Orders, Pricing, and Payment

Unless stated otherwise, prices are listed in U.S. dollars. Payment must be completed through the payment methods available at checkout.

We reserve the right to refuse, delay, cancel, or refund an order where reasonably necessary, including in cases of payment failure, suspected fraud, product unavailability, or an obvious technical, pricing, or configuration error, subject to applicable law.

6. Shipping and Delivery

NICHE SELECT currently ships to eligible addresses within the United States.

Orders are normally prepared and handed to the carrier within 1–3 business days after the order is placed. Business days do not include weekends or federal holidays.

Because most fragrances contain alcohol and are regulated for transportation, NICHE SELECT fragrance orders are shipped using eligible ground transportation services.

NICHE SELECT normally has an expected delivery window of up to 5 business days, although packages containing hazardous materials may take longer and may typically take up to 10 business days. Delivery dates are estimates and are not guaranteed.

Tracking information will be provided via the email address supplied with your order when the order is filled and shipped.

You are responsible for providing a complete and accurate shipping address. If you notice an error, contact us as quickly as possible at hello@nicheselect.co. We will do our best to update the address details if fulfillment has not yet begun.

If we become unable to ship your order within our stated processing time, we will contact you regarding the delay and provide the appropriate cancellation or refund option.

7. Order Changes and Cancellations

If you need to change or cancel an order, contact us at hello@nicheselect.co within 12 hours after placing the order and before the order is filled.

Once an order has been reflaconed, prepared, packed, or otherwise entered fulfillment, we may no longer be able to modify or cancel it.

If we are able to cancel an order before fulfillment, the refund will be issued to the original payment method.

8. Returns, Refunds, Damaged Orders, and Missing Items

Because NICHE SELECT fragrances are 100% authentic and independently reflaconed for sale in smaller atomizers, we do not accept returns or exchanges for preference-based reasons after an order has been delivered safely.

Preference-based reasons include disliking the fragrance or expecting it to smell differently, changing your mind, ordering the wrong fragrance or size, or experiencing different longevity, projection, or performance than expected.

If a fragrance arrives broken or has experienced significant leakage during transit, contact us within 48 hours of delivery at hello@nicheselect.co. Please provide your order number, a brief description of the issue, and clear photographs of the affected product and shipping packaging. Once reviewed, we may provide a replacement or refund for the affected item, depending on the circumstances and product availability.

You will not need to ship a broken or leaking fragrance back to us unless NICHE SELECT specifically requests otherwise. A small amount of moisture around an atomizer does not always indicate substantial product loss.

If we send the wrong fragrance, wrong size, wrong quantity, or accidentally omit an item, contact us within 48 hours of delivery. Once verified, NICHE SELECT will either send the correct item at no additional cost or provide a refund for the affected items. If we made the mistake, you will not be charged for correcting it.

9. Lost Packages and Packages Marked Delivered

If tracking has stopped updating for an unusual amount of time or your package appears to be lost, contact NICHE SELECT at hello@nicheselect.co.

One of our carriers, USPS Ground Advantage, currently includes tracking and up to $100 of included insurance.

If the carrier confirms to you that the package has been lost, please forward that confirmation to hello@nicheselect.co. NICHE SELECT will verify the outcome of the investigation and will generally provide a refund.

If tracking shows a package as delivered but you cannot locate it, first check around the delivery location, including entrances, mailrooms, parcel lockers, household members, neighbors, or building staff. Carrier scans can occasionally occur shortly before a package is physically available.

Replacement or refund decisions for packages confirmed as delivered are evaluated individually based on tracking information, carrier findings, the delivery location, order history, and other relevant circumstances.

10. Decant Volume, Fill Levels, and Fragrance Performance

NICHE SELECT atomizers are prepared according to the volume purchased. Atomizer bottles require some internal headspace for the spray mechanism to function properly, and bottle shape and internal construction can make two atomizers containing the same volume appear visually different. An atomizer may therefore not appear filled completely to the top even when it contains the advertised amount.

Fragrance is highly personal. Descriptions of fragrance notes, longevity, projection, seasonality, occasion, or performance are provided as general guidance and are not guarantees of individual results.

A fragrance performing differently from your expectations does not qualify as a damaged or defective product.

11. Product Safety

Fragrance products may contain alcohol, fragrance compounds, essential oils, allergens, and other ingredients that may cause sensitivity in some individuals.

If you have known allergies or fragrance sensitivities, consult the original manufacturer’s ingredient information when available. NICHE SELECT is not responsible for allergic reactions. Consider testing a small amount before broader application.

Fragrance is intended for external use only.

12. Promotions and Discount Codes

Unless a promotion specifically states otherwise, only one discount code may be used per order. Discounts cannot generally be combined, exchanged for cash, or applied retroactively to orders that have already been placed.

Offers may have specific eligibility requirements or expiration dates. NICHE SELECT may correct or cancel a promotion affected by an obvious technical, pricing, or configuration error.

13. Order Verification and Fraud Prevention

To protect our customers and our business, some orders may require additional verification before fulfillment.

NICHE SELECT may delay, cancel, or refund an order when our payment processor identifies significant fraud risk, when payment information cannot be verified, or when we reasonably believe an order may be unauthorized. If additional information is needed, we will contact you using the information provided with the order.

14. Intellectual Property

Except for third-party trademarks, brand names, fragrance names, product imagery, and other third-party materials, the NICHE SELECT name, logo, branding, website text, original photography, graphics, and other original site content are owned by or licensed to NICHE SELECT and may not be copied, reproduced, distributed, or commercially used without permission, except as permitted by law.

Third-party trademarks, brand names, and other intellectual property remain the property of their respective owners.

15. User Conduct

You agree not to use our website for unlawful purposes, attempt to interfere with website functionality or security, submit fraudulent orders or payment information, or misuse content or intellectual property.

16. Limitation of Liability

To the fullest extent permitted by applicable law, NICHE SELECT will not be liable for indirect, incidental, special, or consequential losses arising from use of the website or products.

NICHE SELECT is not responsible for fragrance preferences, individual variations in fragrance performance, allergic reactions, or injury or loss resulting from misuse of a product, except to the extent liability cannot lawfully be excluded or limited.

17. Privacy

Your use of our website and the information you provide to us are also governed by our Privacy Policy.

18. Accessibility

At NICHE SELECT, we are committed to ensuring that our website is accessible to all individuals, including those with disabilities. Some areas of our website may rely on third-party tools or services, and we cannot guarantee full compliance for third-party integrations. 19. Governing Law

These Terms are governed by the laws of the District of Columbia and applicable federal law, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

We may update these Terms from time to time. The current version will be posted on our website with the date of the latest update. Your continued use of the website or services after updated Terms take effect constitutes acceptance of the updated Terms to the extent permitted by applicable law.
